Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Additional Agreement: an agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance contract, and these are supplied by the entrepreneur or by a third party based on an agreement between that third party and the entrepreneur.

  • Withdrawal Period: the period within which the consumer can exercise their right of withdrawal.

  • Consumer: the natural person who is not acting for purposes related to their trade, business, craft, or profession.

  • Day: calendar day.

  • Digital Content: data produced and delivered in digital form.

  • Long-term Agreement: an agreement for the regular delivery of goods, services, and/or digital content over a certain period.

  • Durable Medium: any tool that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future reference and unchanged reproduction.

  • Right of Withdrawal: the consumer’s ability to withdraw from the distance contract within the withdrawal period.

  • Entrepreneur: the natural or legal person who offers products, (access to) digital content, and/or services to consumers at a distance.

  • Distance Contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling.

  • Model Withdrawal Form: the European model withdrawal form.

  • Means of Distance Communication: means that can be used to conclude a contract without the consumer and entrepreneur having to be in the same space at the same time.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate how the terms can be viewed and that they will be sent free of charge at the consumer's request.

  3. If the distance contract is concluded electronically, the text of these general terms and conditions may be provided to the consumer electronically, so that it can be easily stored on a durable medium.


Article 4 - The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

  2. The offer contains a complete and accurate description of the offered products, digital content, and/or services. If the entrepreneur uses images, these are truthful representations of the products.

  3. Obvious errors or mistakes in the offer do not bind the entrepreneur.


Article 5 - The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.

  2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt electronically.

  3. The entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and provide a secure web environment.


Article 6 - Right of Withdrawal

  1. The consumer can dissolve an agreement regarding the purchase of a product within a withdrawal period of 14 days without giving reasons.

  2. The withdrawal period starts on the day after the consumer or a third party designated by the consumer has received the product.


Article 7 - Obligations of the Consumer During the Withdrawal Period

  1. During the withdrawal period, the consumer shall handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to assess the nature, characteristics, and functioning of the product.

  2. The consumer is liable for any diminished value of the product resulting from handling beyond what is permitted.


Article 8 - Exercise of the Right of Withdrawal by the Consumer and Associated Costs

  1. If the consumer exercises the right of withdrawal, they shall notify the entrepreneur within the withdrawal period using the model form or another unequivocal method.

  2. The consumer shall return the product as soon as possible, but no later than 14 days after the notification.

  3. Return shipping costs are borne by the consumer, unless the entrepreneur agrees to cover them.


Article 9 - Obligations of the Entrepreneur in Case of Withdrawal

  1. The entrepreneur will reimburse all payments received from the consumer, including any delivery charges, without delay and no later than 14 days after the withdrawal notification. The entrepreneur may wait to refund until the product has been received or until the consumer has provided proof of return.

  2. The entrepreneur uses the same payment method for reimbursement as the consumer used in the original transaction.


Article 10 - Exclusion of the Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for:

  1. Products made to the consumer's specifications.

  2. Sealed products that are not suitable for return due to hygiene reasons and whose seal has been broken.


Article 11 - The Price

  1. During the validity period stated in the offer, prices will not be increased, except for VAT changes.

  2. Prices listed in the offer include VAT.


Article 12 - Performance and Additional Warranty

  1. The entrepreneur guarantees that the products and/or services comply with the contract and meet reasonable requirements of reliability and usability.

  2. Any additional warranty does not extend beyond the legal obligations of the entrepreneur.


Article 13 - Delivery and Execution

  1. The entrepreneur will exercise the greatest possible care when fulfilling product orders.

  2. The risk of damage and/or loss of products remains with the entrepreneur until the moment of delivery to the consumer.


Article 14 - Long-term Transactions: Duration, Termination, and Renewal

  1. The consumer may terminate an indefinite-term agreement at any time with a notice period of no more than one month.

  2. A fixed-term agreement may not be tacitly extended or renewed for a fixed duration.


Article 15 - Payment

  1. Unless otherwise agreed, amounts owed by the consumer must be paid within 14 days after the start of the withdrawal period.

  2. If the consumer fails to meet their payment obligation on time, the entrepreneur is entitled to charge extrajudicial collection costs.


Article 16 - Complaints Procedure

  1. Complaints regarding the performance of the contract must be submitted to the entrepreneur clearly described and in full.

  2. Complaints will be answered within 14 days.


Article 17 - Disputes

  1. Dutch law exclusively applies to agreements between the entrepreneur and the consumer.


Article 18 - Additional or Deviating Provisions

Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing or be accessible for future reference.
